1. Agreement to these terms
These Terms of Service (“Terms”) are an agreement between you and Burque Property Inspections LLC (“FORGE,” “we,” “us,” or “our”). By creating an account, starting a trial, purchasing a subscription, or using FORGE, you agree to these Terms and our Privacy Policy. If you use FORGE for an organization, you represent that you have authority to accept these Terms for that organization.
2. The service
FORGE is a construction project operations platform that helps authorized teams organize project information, bids, schedules, notes, follow-ups, documents, estimates, time records, and client updates. FORGE is offered in the United States only at this time.
3. Accounts and access
You are responsible for providing accurate account information, protecting login credentials, and ensuring that each person you invite has appropriate authority to access your workspace. You must promptly notify us at support@forgepm.app if you suspect unauthorized access. You are responsible for activity conducted through your account and for the content your authorized users add to FORGE.
4. Subscriptions, trials, and billing
Paid subscriptions are processed through Stripe. Team and Growth plans require payment information at signup. The Solo plan may include a 14-day trial without a payment method; if no payment method is provided by the end of that trial, the trial account is canceled rather than converted to a paid subscription.
Prices, billing intervals, plan capacity, renewals, upgrades, downgrades, cancellations, and invoices are shown at checkout or in FORGE's billing tools. Upgrades may take effect immediately and be prorated. Downgrades generally take effect at the next renewal, subject to plan user limits. Fees are non-refundable except where required by law or expressly agreed by FORGE. You are responsible for applicable taxes.
5. Your data and acceptable use
You retain ownership of the project and business information you enter into FORGE. You grant us the limited right to host, process, transmit, and display that information solely to provide and support the service.
You may not use FORGE to break the law, infringe rights, upload malicious code, interfere with the service, bypass security controls, access another customer's workspace without permission, or use the service to develop or operate a competing service through automated extraction or reverse engineering where prohibited by law.
6. AI-assisted features
FORGE may use third-party AI services to create requested drafts, summaries, and reports from the information an authorized user supplies. AI-generated content may be incomplete or inaccurate and is not professional, legal, financial, safety, engineering, or construction advice. You are responsible for reviewing all outputs before sharing or relying on them.
7. Service availability and changes
We work to keep FORGE available and reliable, but we do not guarantee uninterrupted or error-free operation. We may change, improve, suspend, or discontinue features when reasonably necessary for security, maintenance, legal compliance, or product development.
8. Intellectual property
FORGE, its software, design, branding, and documentation are owned by Burque Property Inspections LLC or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to use FORGE for your internal business purposes during your subscription.
9. Disclaimer and limitation of liability
FORGE is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We disclaim implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. To the maximum extent permitted by law, FORGE and its owners, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill.
To the maximum extent permitted by law, FORGE's total liability arising from or related to the service will not exceed the amount you paid to FORGE for the service in the twelve months before the event giving rise to the claim.
10. Indemnity
You will defend, indemnify, and hold harmless FORGE and its owners, employees, and suppliers from claims, damages, liabilities, and expenses arising from your use of FORGE, your data, or your violation of these Terms or applicable law.
11. Termination
You may stop using FORGE and cancel your subscription through the billing tools or by contacting support. We may suspend or terminate access for nonpayment, misuse, security risks, or violation of these Terms. Upon termination, your right to use FORGE ends, subject to the data-retention practices described in our Privacy Policy.
12. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Any dispute arising from these Terms or FORGE will be brought exclusively in the state or federal courts located in New Mexico, and you consent to their jurisdiction and venue.
13. Changes and contact
We may update these Terms by posting a revised version and updating the effective date. Continued use after the effective date means you accept the revised Terms. Contact us at support@forgepm.app.
